Texas RV and towable lemon law

Texas is one of the few states whose lemon law reaches the whole motor home — living facilities included — and TxDMV administers RV complaints through the same Lemon Law section as cars. Towable RVs (travel trailers and fifth wheels) are handled by TxDMV when they are titled and registered in Texas and the defect is in a manufacturer-warranted system; purely cosmetic and wear items are not nonconformities.

The Texas rules that decide RV files

  • The staggered presumption clocks apply: first repairs inside 12 months / 12,000 miles (road miles for the chassis), the pattern inside 24 / 24,000.
  • Written notice + cure opportunity (§2301.606(c)), then a TxDMV complaint — exhaustion is mandatory before suit (§2301.607).
  • The filing deadline: 6 months after the earliest of warranty expiry, 24 months, or 24,000 miles (§2301.606(d)).
  • The hearing-rule deduction (16 TAC §107.8(4)): miles to first report at full weight, later miles at half weight, over 120,000.

Information, not legal advice. RV files turn on which system failed and who warranted it — chassis builder, coach builder, or appliance maker. The repair log should name the system on every visit.
