Verified against the statute / official state publicationWyo. Stat. §40-17-101
| Presumption window | Wyoming's presumption window reads 'within the term of the express warranty or within one year following original delivery, whichever is LATER' — one of only two 'later of' windows in the country. |
|---|---|
| Same defect | 4+ repair attempts |
| Days out of service | 30+ business days — 30 or more BUSINESS days out of service. |
The presumption is the set of numbers that shifts the burden to the manufacturer. A claim can exist outside the presumption — it is a shortcut, not the whole road. Read why.
Wyoming allows a reasonable allowance for the consumer's use with no published formula. This checker refuses to invent the number.
The presumption never applies unless the manufacturer received prior direct written notification and a reasonable opportunity to cure (§40-17-101(h)).
Dispute route: Exhaustion of a compliant manufacturer's dispute procedure is a precondition to the refund/replacement duty.
Attorney's fees: A consumer injured by a violation may recover reasonable attorney's fees (§40-17-101(j)).
Wyoming's statute prints no separate filing deadline; the warranty/1-year (whichever later) window and the exhaustion of the manufacturer's dispute procedure are the operative clocks.
