Verified against the statute / official state publication9 V.S.A. §§4170–4181
| Presumption window | Vermont has no month/mile cap: at least the FIRST repair attempt must occur within the express warranty term, and the 30 days must fall during the warranty term. |
|---|---|
| Same defect | 3+ repair attempts |
| Days out of service | 30+ calendar days |
The presumption is the set of numbers that shifts the burden to the manufacturer. A claim can exist outside the presumption — it is a shortcut, not the whole road. Read why.
Vermont allows a reasonable allowance for consumer use with no published formula. This checker refuses to invent the number.
After the threshold is met, send written notice to the manufacturer on the state forms. You then choose: the manufacturer's dispute mechanism or the Vermont Motor Vehicle Arbitration Board. The manufacturer must tell you about the choice and supply the forms.
Dispute route: The Vermont Motor Vehicle Arbitration Board is free (funded by an $8 warranty fee at registration). Hearings run within 45 days; the manufacturer gets a final repair attempt during that period.
Attorney's fees: Vermont provides attorney's fees to a prevailing consumer.
File within 1 year following the expiration of the express warranty term.
