The presumption is the set of numbers that shifts the burden to the manufacturer. A claim can exist outside the presumption — it is a shortcut, not the whole road. Read why.
Missouri allows a reasonable allowance for the consumer's use (§407.567) with no published formula. This checker refuses to invent the number.
Direct written notice to the manufacturer and an opportunity to cure are elements of the Missouri presumption (§407.563). After you deliver the vehicle to the designated facility, the manufacturer has 10 calendar days to conform it.
Dispute route: If the manufacturer maintains a Part 703-compliant procedure, you may be required to complete it before the refund/replacement remedy.
Attorney's fees: A consumer who complies with the statute and finally prevails may recover costs, expenses, and reasonable attorney's fees.
Any action must be commenced within 6 months after the express warranty expires, or 18 months after original delivery — the earlier framework in §407.573.
