New York's used-car lemon law (GBL §198-b)

Used cars in New York do not borrow the new-car law — they have their own. Section 198-b requires the selling dealer to give a written warranty on covered systems, with the term set by the odometer at sale. Price at least $1,500; under 100,000 miles at sale.

Miles at saleDealer warranty termCovers
18,001–36,00090 days or 4,000 milesEngine, transmission, drive axle, brakes, steering, and the other systems listed in §198-b
36,001–79,99960 days or 3,000 miles
80,000–100,00030 days or 1,000 miles

If the dealer cannot repair a covered defect within the warranty, §198-b obliges the dealer to repair, replace, or refund under the statute's terms. The claim runs against the dealer — not the manufacturer. Below 18,001 miles at sale, check the new-car law first: a defect reported within 18,000 miles of ORIGINAL delivery may still be a §198-a case.
