Guide
Texas does not use a simple 'four attempts' rule. The same-defect test is staggered: 2 attempts in the first 12 months or 12,000 miles, and 2 more within the 12 months or 12,000 miles after the first repair. For a serious safety defect: 1 attempt in the first 12/12, and a second within the following 12/12. For days out of service: 30 or more total days inside the first 24 months or 24,000 miles, with at least 2 repair efforts in the first 12/12.
The stagger is the trap. Four attempts that all happen in month 14 do not meet the same-defect test, because the first pair had to land in year one. And the filing deadline is its own trap: 6 months after the earliest of the warranty expiring, 24 months, or 24,000 miles.
Before any lawsuit: written notice to the manufacturer with a chance to cure, then a complaint to the Texas Department of Motor Vehicles. TxDMV exhaustion is mandatory — a court will send you back if you skipped it.
