California · AB 1755
Since January 1, 2025, a California lemon claim runs on one of two procedural tracks, decided by whether the manufacturer elected the AB 1755 fast track (Code Civ. Proc. §§871.20–.30). The election is irrevocable for 5 consecutive calendar years. The Department of Consumer Affairs' Arbitration Certification Program publishes the roster every December 15 and adds verified elections within 2 business days.
Roster checked October 23, 2026. This is a snapshot of the official DCA roster as read on that date. Elections can be added — verify against the live DCA roster before filing, especially near a December 15 update.
Plus roughly 40 RV and chassis builders (Airstream, Forest River, Jayco, Keystone, Thor, Tiffin, Winnebago among them).
| Fast track (opted in) | Standard track | |
|---|---|---|
| Filing deadline | Earlier of 1 year after the express warranty expires and 6 years after original delivery (§871.21), tolled for out-of-service time | No single printed deadline — discovery-based and fact-specific |
| Penalty-preserving notice | §871.24 notice at least 30 days before suing: name, accurate 17-character VIN, brief repair summary, repurchase/replacement demand | No §871.24 mechanism; written demand still builds the record |
| After a signed release | Restitution/replacement within 30 days; mandatory $50 per late day (§871.27) | Song-Beverly general rules |
| Litigation pace | Disclosures 60 days · depositions (2 hrs) 120 days · mediation scheduled 90 / held 150 · discovery stayed until mediation ends (§871.26) | Ordinary civil procedure |
Do not copy a law-firm tracker. At least one prominent firm's tracker marks Toyota, Honda, Tesla, BMW and Volkswagen as opted-in while its own brand pages say Tesla and VW are not. The roster above follows the official DCA readings: Toyota/Lexus, Honda/Acura, Tesla, BMW, Volkswagen/Audi/Porsche, Volvo, Mazda, Rivian and Lucid are NOT opted in.
